Terms of Service

Terms of Service updated on January 24 2023. Version Number 1.2

I. Conduct
1. All parties are required to communicate in a polite, respectful, and concise manner.
2. All relevant reference material(s) and forms shall be submitted before work is started and payment sent. An up to date reference sheet is highly recommended.
3. No discussion of political and/or religious beliefs will be tolerated. If brought up, B0RKB1T3Z reserves the right to deal with it as seen fit. (See refunds and discontinuations)
4. Small talk will be tolerated unless it is interfering with B0RKB1T3Z’S work.
5. Failure to abide by the terms outlined may result in commission being denied or canceled without refund.
II. Payment
1. Upfront payment is required for B0RKB1T3Z to begin work on any commission, unless previously discussed.
2. Payment will be requested via ZELLE, CASH APP, KOFI, PAYPAL, AMAZON WISHLIST ITEMS, DISCORD NITRO, or GIFT CARDS only. (Subject to change)
3. USD only.
4. B0RKB1T3Z will send a personalized invoice with the amount owed. Do not lose this as this is your receipt!
5. If deadline is requested, a rush fee of 10% - 20% of the total will be added according to the size of B0RKB1T3Z’S queue.
6. Forcing chargebacks or even trying to chargeback will result in a blacklist from all future commissions
III. Process
1. Watermarked WIPs will be sent when B0RKB1T3Z finishes each stage of the commission (sketch, lines, color, etc).
2. General turn around time is no longer than one week to one month, unless otherwise stated.
3. Under any circumstance the process must be delayed, the client will be notified.
4. Any error the client sees at any point during the commission process must be communicated to B0RKB1T3Z. Additionally, the client has 36 hours from the time they receive their finished art to notify B0RKB1T3Z of any error they have missed during the commission process. (See 36 hour alteration policy)
5. Any change in character design that occurs during the commission process must be communicated to B0RKB1T3Z BEFORE work is completed.
6. B0RKB1T3Z does not work off of descriptions! An up to date reference sheet is required.
IV. 36 Hour Alteration Policy
In the case that the client fails to notify B0RKB1T3Z of errors during the commission process, B0RKB1T3Z will acknowledge any requests to resolve said errors no more than 36 hours after finished work is sent to the client. This does not apply to character design changes that must be communicated while B0RKB1T3Z is still working. Anything communicated outside the 36 hours will incur a $10 fee to resolve.
V. Cancellations, Holds, and Refunds
cancellations and refunds:
1. B0RKB1T3Z reserves the right to cancel the commission at any time with or without a refund. Cancellations from B0RKB1T3Z’s end are unlikely unless the client fails to abide by the Terms of Service.
2. Refunds will be given based on how much work B0RKB1T3Z has completed.
3. Once work is completed, no refunds will be given.
4. If the client ceases contact with B0RKB1T3Z, the commission will be considered concluded and no refunds will be given. B0RKB1T3Z acknowledges emergency situations (I.E. family emergency, lost power/ access to internet, natural disasters, etc) and will issue a refund if requested or finish the commission.
5. Forcing a chargeback will result in personal and public blacklisting. All rights that may have been bestowed in relation to the artwork will be revoked, and appropriate actions may be taken.
6. Requests for a refund must be talked through with B0RKB1T3Z. B0RKB1T3Z will send current work upon request if work has already been started.
Holds:
1. B0RKB1T3Z reserves the right to put any commission on hold at any time. Should it be necessary, the client will be notified and an estimated time of resume will be provided.
VI. Copyright and Usage
1. Under no circumstances should
B0RKB1T3Z’s signature be removed from the artwork.
2. Art may not be modified by anyone other than B0RKB1T3Z.
3. B0RKB1T3Z reserves full rights (except character rights) to the work produced.
4. Artwork posted to social media must credit B0RKB1T3Z. (@b0rkb1t3z on toyhouse, Instagram, Twitter, and TikTok. @razerwantsahug on fur affinity)
5. All commissions are for personal use unless otherwise agreed upon.
6. Under no circumstances may personal, non commercial art be used for the purposes of making or promoting monetized content by anyone but B0RKB1T3Z.
7. If you wish for your commission not to be used for advertising, please inform B0RKB1T3Z as soon as possible!
VII. Physical Items
1. B0RKB1T3Z is not responsible for the package once it is in the mail. That being said, if it gets lost in the mail, B0RKB1T3Z can not be responsible for it.
2. In the case that the package is lost in the mail, please notify B0RKB1T3Z and, if needed, the commission will be completed again free of charge.
3. Please supply your legal name and current address! Do not send a screen name as this can result in the package getting “lost”. This info will be collected via Google form and response’s deleted a month after the package has been shipped in case it gets lost.
4. Buyer pays shipping! (It shouldn’t be too much)
5. In the case that the product arrives damaged, please notify B0RKB1T3Z and supply an image. A replacement will be sent!
6. If a change of address occurs, please notify B0RKB1T3Z immediately! Once the package is sent, there’s not much B0RKB1T3Z can do about address changes.
7. B0RKB1T3Z will not ship to anyone under 18 without parental consent! A form will be provided for them to sign and sent back via EMAIL to [email protected]
